Ownership of rights

Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use, is prohibited without permission. You may not modify, distribute or repost anything on this website for any purpose.

Accuracy of content

We have taken every care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been fairly described. However, orders will only be accepted if there are no material errors in the description of the goods or their prices as advertised on this website. If the price of the goods increases between the date we accept your order and the delivery date, I will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable, then you will of course have the right to cancel your order. Any dimensions given about the goods are approximate only. To the extent permitted by applicable law, Ceramic Fabrics disclaim all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website and shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials contained on this website.

Availability

All items are subject to availability. I will inform you as soon as possible if the goods you have ordered are not available. I aim to have products in stock at all times. If your ordered item is not in stock, I can back order for you. You will always be emailed with the option to cancel your order if you would rather not wait. Ceramic Fabrics issue a pro-forma invoice ~ this simply means that your order will be packed and weighed for postage then an invoice will be sent. On receipt of your payment your goods will be dispatched.

Accounts

No goods will leave the premises without payment unless by prior agreement with myself. Any queries or problems, please let me know. Ceramic Fabrics will not charge for any item until it is ready to ship. Payments are taken via BACS.

Delivery charges

Delivery charges vary according to the number of goods ordered and cannot be refunded.

Delivery

Ceramic Fabrics will deliver the goods to the address you specify for delivery in your order. It is important that this address is accurate. Please be precise about where you would like the goods left if you are out when delivered, however, goods will not be left without a signature. If you indicate the parcel is to be left anywhere without a signature when ordering, it will be at your own risk and the responsibility of the parcel is then yours, any loss will then not be refundable. Ceramic Fabrics cannot accept any liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions. Ceramic Fabrics will aim to deliver the goods by the date quoted for delivery but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, the delivery date will be extended by a reasonable period and we will contact you to arrange an alternative time.

Acceptance

Ceramic Fabrics must be advised in writing by recorded delivery of any defects in the Goods as soon as they are discovered by the Buyer who shall be deemed to have accepted the Goods if they have not been rejected on or before the seventh day after delivery. The Buyer shall not be entitled to reject the Goods in whole or in part thereafter. Any shortages/damages need to be advised to us within 7 days of receipt of the delivery or we cannot accept any responsibility for damage or replacements.

Risk and ownership

Risk of damage to or loss of the goods passes to you at the time of delivery to you, or if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the goods once they have been successfully delivered and when we have received cleared payment in full.

Acknowledgement and acceptance of your order

You will need to provide us with your e-mail address and we will notify you by e-mail as soon as possible to confirm receipt of your order. An acceptance of your order will take place on payment and dispatch of the good(s) ordered.

Title and risk

The Goods shall be at the risk of the Buyer following delivery and, notwithstanding delivery, title in the Goods shall not pass to the Buyer until the Buyer has made payment of all sums owing to the Company failing which the Company shall have the right to repossess or otherwise recover the Goods.

Returns policy

Please note sale or custom made items cannot be returned unless faulty or damaged. This does not affect your statutory rights. If goods you have ordered are faulty or damaged, within 7 days of receipt you may return them to us at your cost. They must be returned with the original paperwork and in the same condition as when they were dispatched, Ceramic Fabrics will then arrange a refund. If goods are returned damaged, Ceramic Fabrics reserve the right to make a charge.

Prices

Although these are correct at the time of printing Ceramic Fabrics reserve the right to change them without prior warning. For larger orders I will endeavour to contact and inform you of any price increases. All prices are excluding carriage at the current rate.

Limitation of liability

Save in respect of personal injury or death due to any negligence, Ceramic Fabrics shall not be liable to the Buyer in respect of any loss suffered by the Buyer due to any defect in the Goods. Without prejudice to Condition 6.1 Ceramic Fabrics shall not be liable to the Buyer or any third party for any loss of profit, consequential or other economic loss suffered by the Buyer arising in any way from this Agreement.

Set off and counter-claim

The buyer may not withhold payment of any invoice or other amount due to Ceramic Fabrics by reason of any right of set-off or counter-claim which the buyer may have or alleged to have or for any reason whatsoever.

Changes to legal notices

Ceramic Fabrics reserve the right to change these terms and conditions from time to time and you should look through them as often as possible.

Force majeure

Ceramic Fabrics shall not be liable for any default due to any circumstance beyond the reasonable control of the Company including, but not limited to, Acts of God, war, civil unrest, riot, strike, lock-out, acts of civil or military authorities, fire, flood, earthquake or shortage of supply.

Privacy policy

I do not disclose buyer's information to third parties other than when the order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party.

Law, jurisdiction and language

This website, any content contained therein and any contract brought into being as a result of usage of this website are governed by and construed in accordance with English law. Parties to any such contract agree to submit to the exclusive jurisdiction of the courts of England and Wales. All contracts are concluded in English.
